Last Night I wrote a comment about that I think that we were discussing about a fake gif, today a good friend send me a youtube link that compare gif with official video image from FOM, and is very clear that no flag is waving on the marshall post.

Sorry Matt I could not see BBC video cause it is not available in my territory, If you check this video on board in real time, you can see that Vettel Overtook Marusia in Lap 3 on green lights (in front of Marshall post) and Vergne in Lap 4 on yellow flashing lights. When I see the A3 video (F1 TV Holders in Spain so I suppoused that it is the same video than BBC, because is the same signal all over the world) I can see the same screen shot that you took on lap 3.

Matt very interesting, is important to say that your marshall screen shot is from lap 3 when the light in front of it were green, in lap 4 the light were yellow flashing, like anybody can see in the onboard video that I post on page 8 or 9.29th November 2012, 1:15 at 1:15 am #216067FernandoMember@Keith Collantine

If, in events forming part of a FIA Championship, a new element
is discovered, whether or not the stewards of the meeting have
already given a ruling, these stewards of the meeting or, failing
this, those designated by the FIA, must meet on a date agreed
amongst themselves, summoning the party or parties concerned
to hear any relevant explanations and to judge in the light of the
facts and elements brought before them.
The right of appeal against this new decision is confined to the
party or parties concerned in accordance with the final paragraph
of Article 180 and the following Articles of this Code.
Should the first decision already have been the subject of
an appeal before the National Court of Appeal or before the
International Court of Appeal, or successively before both of
these courts, the case shall be lawfully submitted to them for
the possible revision of their previous decision. The International
Court of Appeal may take up the review of a case that it has
judged, either on its own initiative or upon an appeal in review
brought by the FIA President or by one of the parties concerned
and/or directly affected by its former decision.
The period during which an appeal in review may be brought
expires on 30 November of the year during which the decision
that is liable to review has been handed down, if that decision is
likely to have an effect on the result of a championship.That Means thar If FIA do not investigated it by thenselves with the new elements, Any parties concerned, (Ferrari, Alonso, Mercedes, Schumacher, Toro Rosso or Vergne) can appeal to the International Court Appeal.

Kers is begining to use it when indicator lights on, not when it begin to decrease, it is not like DRS that need authorization to use it, they can use it when ever they want. I can see it very clear in the gif, but not so clear in the video without rev counter on the screen. What do you think about the incredible speed that the marshall shown in the gif?, I think that he has an arm faster than the redbull, maybe the faster arm on the earth because if you look the minimun distance that the redbull run along and the double movement that the marshall can do in that short period of time it is at least amaizing.29th November 2012, 0:23 at 12:23 am #216046FernandoMember@Mark
On lap 3 lights are green but on lap 4 when Vettel overtakes is a yellow flashing lights very clear. But lights are not a simply repeater mechanism, lights are activated by Charlie Whiting on control tower, you can read it on the lights providers web site.

I know that Monaco were a different case, but what I tried to explain is that FIA when that happends explain that in all the cases Race Director decissions and signals (Lights, cockpit leds, monitors advices, etcc…) are over any marshall indication. That is logical.
But if you prefer to think that that is not the way rules work. You take a look to the rev counter and you can check that Vettel begins to use KERS before the Marshall post, and that is not allowed in yellow flag conditions, FIA explain a few races ago that in yellow flags condition no KERS or DRS is allowed.

But most of all, Lights are manipulated by Charlie Whiting on Control Tower, he is the main person during the race, his decision has priority over any marshall or flag. FIA Explained it when Schumi overtake Alonso during Monaco 2010 last lap. - AuthorPosts
